Sanders Fine Portraits Official Giveaway Rules Family Giveaways and Family and Furbaby Giveaways NO PURCHASE IS NECESSARY TO ENTER OR BE SELECTED. A PURCHASE WILL NOT INCREASE THE CHANCE OF SELECTION. These Official Giveaway Rules apply to portrait giveaways and special projects offered by Sanders Fine Portraits, Inc. Each giveaway announcement, entry page, or application form (the "Giveaway Notice") will identify the applicable project, entry period, number of available awards, selection method, and any additional project-specific requirements. The Giveaway Notice and these Official Rules together govern the applicable giveaway. If the Giveaway Notice contains a project-specific term that differs from these Official Rules, the Giveaway Notice controls only as to that project-specific term. 1. Sponsor The sponsor is Sanders Fine Portraits, Inc., 3556 Western Avenue, Suite 101, Highland Park, Illinois 60035 ("Sanders Fine Portraits" or the "Sponsor"). Eligibility Unless a Giveaway Notice states otherwise, the giveaway is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years old at the time of entry and who are able to attend the required appointments at the Sanders Fine Portraits studio in Highland Park, Illinois. The giveaway is void where prohibited or restricted by law. A person is not eligible if, during the 365 days before entering, that person or a member of the same household has received a Sanders Fine Portraits giveaway award, complimentary portrait certificate, or other promotional portrait offer. Employees, officers, directors, contractors, and agents of the Sponsor, as well as their immediate family members and household members, are not eligible. The Sponsor may require reasonable documentation to verify eligibility. 3. Agreement to the Rules By entering, each applicant confirms that the information provided is accurate, that the applicant meets the eligibility requirements, and that the applicant agrees to these Official Rules and the applicable Giveaway Notice. The Sponsor's decisions concerning eligibility, administration, and selection are final to the extent permitted by law. 4. Entry Period The opening and closing dates and times for each giveaway will appear in the Giveaway Notice. All times are Central Time unless the Giveaway Notice expressly states otherwise. The Sponsor's electronic systems are the official timekeeping device. Entries received before the opening time or after the closing time are not eligible. 5. How to Enter Complete and submit the official online entry or application form identified in the Giveaway Notice. Unless the Giveaway Notice permits otherwise, limit one entry per person and one entry per household for each giveaway. Entries must be complete and received during the applicable Entry Period. No purchase, payment, or previous relationship with Sanders Fine Portraits is required. Entries generated by bots, scripts, automated methods, multiple identities, or other attempts to exceed the stated entry limit are prohibited. The Sponsor may disqualify entries that are incomplete, inaccurate, fraudulent, submitted through unauthorized methods, or otherwise violate these Official Rules. 6. Giveaway Projects The applicable Giveaway Notice will identify one of the following projects: Family Giveaway. The commissioned portrait is focused exclusively on the people in the selected recipient's family. Family and Furbaby Giveaway. The commissioned portrait may include the selected recipient's family and dog or dogs, subject to the studio safety requirements in Section 10. Applications are project-specific. An entry submitted for one project does not automatically constitute an entry in another project. 7. The Award Unless a Giveaway Notice expressly provides a different portrait, each selected recipient will receive a certificate redeemable for one unframed 14-inch commissioned canvas portrait in the Sanders Fine Portraits Classic finish with hand artistry. The approximate retail value of the portrait is $3,000. The awarded item is the finished portrait. The planning consultation, photographic appointment, viewing and selection appointment, professional posing, and artistic guidance are the standard studio process used for every Sanders Fine Portraits commission. Those appointments are provided as necessary to create and select the awarded portrait and are not separate prizes with an independent cash value. The included portrait is unframed. Custom framing, additional portraits, upgraded sizes or finishes, and any other artwork or products are available only if the recipient chooses to purchase them. Digital files are not included unless the Giveaway Notice expressly states otherwise. No additional purchase is required to receive the awarded portrait. The certificate and portrait are nontransferable, may not be sold, assigned, or redeemed for cash, and have no cash redemption value. The certificate may be used only for the portrait described in these Official Rules and the Giveaway Notice. The Sponsor may substitute an award of equal or greater value if the stated portrait becomes unavailable for reasons beyond the Sponsor's reasonable control. The Sponsor will comply with any tax reporting obligation required by applicable law; recipients should consult their own tax adviser regarding individual circumstances. The number of available awards will be stated in the Giveaway Notice. If no number is separately stated, one award will be available. Travel, lodging, transportation, meals, wardrobe, and other personal expenses are not included. 8. Appointment and Redemption Requirements A selected recipient must complete the standard studio planning, photographic, viewing, and selection appointments so the awarded portrait can be created. Appointments are subject to studio availability and must be scheduled and completed by the deadlines stated in the Giveaway Notice, certificate, or selection notice. Failure to respond, schedule, or complete the required appointments by those deadlines may result in expiration of the award and selection of an alternate recipient. Sanders Fine Portraits requires the same $200 reservation deposit used to hold private studio time for all portrait clients. The deposit is collected only when an appointment is scheduled. It is not an entry fee, a purchase, payment for the awarded portrait, or a condition of being selected or accepting the certificate. The deposit is refunded in full at the scheduled appointment. At the recipient's voluntary direction, it may instead be applied to an order for additional artwork or framing. If the appointment is cancelled and does not take place, the deposit will be returned. No recipient is required to purchase anything beyond the awarded portrait. 9. Selection Method and Odds The Giveaway Notice will state whether recipients are selected by random drawing or application review. Random drawing. The odds of selection depend on the number of eligible entries received. Application review. Applications may be evaluated for completeness, relevance to the stated project, the applicant's story and connection to the project, and the Sponsor's ability to safely and artistically complete the proposed portrait. Because artistic and project-fit considerations are subjective, the Sponsor's good-faith decisions are final. A purchase, deposit, or decision to acquire additional artwork is never considered in the selection process and does not improve an applicant's chance of selection. 10. Family and Furbaby Studio Requirements Dogs are the only pets photographed in the studio. A recipient who wishes to honor another kind of pet may ask the studio about bringing a framed portrait of that pet for artistic incorporation into the family portrait. Any such arrangement must be approved during the planning process. Dogs do not need professional training, but they must remain on leash unless a staff member directs otherwise. For the safety of staff, clients, and other families, dogs with a bite history or signs of aggression are not permitted in the studio. The recipient must disclose any known behavioral, medical, or mobility concerns before the appointment. The Sponsor may pause, modify, or end dog participation if reasonably necessary for safety. When a dog cannot safely participate, the Sponsor will work with the recipient on an appropriate family-portrait alternative so the recipient may still redeem the awarded portrait. 11. Recipient Notification and Verification Selected recipients will be contacted using the telephone number or email address provided with the entry, generally within five days after selection. A selected recipient must respond within 10 calendar days after the first notification unless a different response period is stated in the Giveaway Notice. The Sponsor is not responsible for an applicant's failure to receive a notice because of inaccurate contact information, spam filtering, security settings, or other circumstances outside the Sponsor's reasonable control. Before an award is confirmed, a selected recipient may be required to verify eligibility and sign an eligibility declaration, award acknowledgment, liability release, or other documents reasonably related to the giveaway and portrait commission. If the selected recipient is ineligible, cannot be contacted, does not respond on time, declines the award, or does not complete required verification, the award may be forfeited and an alternate recipient may be selected using the same selection method. 12. Entry Materials and Publicity By entering, the applicant grants the Sponsor and its authorized representatives a nonexclusive, worldwide, royalty-free right, where permitted by law, to use the applicant's name, likeness, statements, and submitted entry materials in connection with administering, announcing, and promoting the giveaway and Sanders Fine Portraits, without further compensation, notice, review, or approval. Entry itself constitutes the applicant's permission for these uses. The applicant represents that the applicant has the right to submit the entry materials and grant this permission. Use of a finished portrait will also be governed by the studio's standard portrait and model release. Any adult or minor pictured who did not personally enter must be covered by an appropriate release signed by that adult or by the minor's parent or legal guardian. 13. Communications and Privacy By entering, an applicant agrees that the Sponsor may contact the applicant by telephone or email for purposes of administering the giveaway, confirming eligibility, and scheduling if selected. Entry does not require consent to receive unrelated marketing calls or text messages. Any marketing consent will be requested separately and may be withdrawn as provided in that consent. Information submitted in connection with a giveaway is handled according to the Sanders Fine Portraits Privacy Policy at www.sandersportraits.com/privacy. 14. Administration and Modification The Sponsor may suspend, modify, or cancel a giveaway if fraud, technical failure, unauthorized interference, natural disaster, public emergency, legal restriction, or another circumstance beyond the Sponsor's reasonable control materially affects the fairness, security, or proper administration of the giveaway. If reasonably possible, the Sponsor will select recipients from eligible entries received before the affected time, using the selection method stated in the Giveaway Notice. The Sponsor may disqualify a person who tampers with an entry form or website, uses unauthorized automated entry methods, submits false information, interferes with administration, or materially violates these Official Rules. Nothing in these Official Rules restricts an entrant's right to provide an honest review, communicate with a government agency, or exercise any other legally protected right. 15. Release and Limitation of Liability To the fullest extent permitted by law, entrants release the Sponsor and its owners, officers, employees, contractors, and agents from claims arising from participation in the giveaway or the acceptance or use of an award, except to the extent a claim results from a released party's willful misconduct or cannot legally be waived. The released parties are not responsible for lost, late, incomplete, corrupted, misdirected, or technically defective entries or communications caused by circumstances outside their reasonable control. Nothing in these Official Rules limits rights or remedies that cannot lawfully be excluded or waived. 16. Disputes and Governing Law These Official Rules and each giveaway are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles. To the extent permitted by law, any dispute arising from a giveaway that cannot be resolved informally must be brought individually in a state court located in Lake County, Illinois, or in a federal court with jurisdiction serving that county. Each party retains any rights that cannot lawfully be waived. 17. Social Media Platforms A giveaway promoted through Facebook, Instagram, or another social media platform is sponsored and administered solely by Sanders Fine Portraits unless the Giveaway Notice expressly states otherwise. It is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, Meta, or any other platform through which it is promoted. By entering, each applicant releases the applicable platform from claims arising from the giveaway to the extent permitted by law. Questions must be directed to Sanders Fine Portraits, not to a social media platform. 18. Recipient List and Copies of the Rules Where required by law, the first name, last initial, city, and state of confirmed recipients may be made available after the giveaway concludes. To request the recipient list or a copy of these Official Rules, send a written request and a self-addressed, stamped envelope to Sanders Fine Portraits Giveaway Rules, 3556 Western Avenue, Suite 101, Highland Park, Illinois 60035. The request must identify the specific giveaway and be received within 60 days after its stated closing date. 19. General Provisions If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions will remain in effect. The Sponsor's failure to enforce a provision is not a waiver of that provision. Headings are included for convenience and do not change the meaning of these Official Rules.
